fx2live, Inc. ("fx2live," "we," "us," or "our"), located at 100 E 21st Street, Brooklyn, NY 11226, provides an AI-powered management platform for daycares, preschools, and early-education programs (the "Service"). This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights available to you.
We built fx2live around a simple idea: children's data deserves a higher standard. We do not sell personal information, we do not use it for advertising, and we do not use children's data to train AI models made available to anyone else.

1. Who's who: our role with your data
How this policy applies depends on your relationship with us:
- Childcare programs ("Customers"). When a center uses the Service to manage its operations, the center decides what data goes into the platform and who can see it. For data the center submits — including children's records — fx2live acts as a service provider / processor on the center's behalf and processes it under our agreement with the center.
- Parents and guardians ("Family Users"). Your child's program invited you to the Service. The program controls your child's records; we process them to provide the Service to the program. For questions about your child's records — or to exercise rights over them — start with your program; we support them in responding.
- Staff Users. Your employer (the program) administers your account; we process your data to provide the Service.
- Website visitors and prospects. When you browse fx2live.com or contact us directly, fx2live is the controller of that information.
2. Information we collect

Information collected automatically
- Device and usage information: IP address, device and browser type, app version, pages and features used, timestamps, and crash logs.
- Approximate location derived from IP address (e.g., for security and check-in verification features a program enables).

- Contact and demo requests: name, email, program name and size, and anything you include in your message to hello@fx2live.com.
3. Children's privacy
The Service stores information about children because childcare programs use it to run their operations. Our handling of children's data follows these rules:
- Children are not users. The Service is designed for and used by adults (program staff and family members). We do not knowingly allow children to create accounts, and the Service is not directed to children.
- Programs obtain consent. Children's information is submitted by the child's program or family. Programs are responsible for obtaining the parental consents and providing the notices required by applicable law (including, where applicable, COPPA's school-authorization framework and state student/child privacy laws) before enabling features like photo sharing or AI-assisted reports.
- Strict purpose limitation. We use children's data solely to provide the Service to the child's program. We never use it for advertising or marketing, never sell it, and never use it to build profiles for any purpose outside the Service.
- Per-child controls. The platform enforces per-child opt-out flags for photo sharing and AI-assisted features, as recorded by the program.
- Deletion. When a program deletes a child's record (or terminates service and requests deletion), we delete the child's data from active systems and purge it from backups on a fixed schedule, subject to legal retention requirements. Parents may also direct deletion requests through their program.
- If we learn of unauthorized children's data, collected outside these channels, we will delete it promptly. Contact us at hello@fx2live.com.
4. How we use information
- Provide, operate, secure, and support the Service (including hosting, backups, troubleshooting, and customer support);
- Process transactions and send Service-related communications (invoices, alerts, daily reports, announcements);
- Power features the program enables, including AI Features as described in Section 5;
- Monitor for fraud, abuse, and security incidents, and enforce our Terms of Service;
- Improve the Service, using aggregated or de-identified data wherever possible;
- Comply with legal obligations;
- For website visitors and prospects only: respond to inquiries and, with your consent or as permitted by law, send marketing about fx2live (you can opt out anytime).
We do not use personal information for third-party advertising, and we do not sell or "share" (as defined by applicable state privacy laws) personal information.
5. How our AI features use data
- Purpose-bound processing. FX2 Copilot processes the data already in your program's account (activity logs, schedules, records) to generate drafts, summaries, forecasts, and answers for that program only.
- No public model training on children's data. We do not use children's data to train AI models that are made available to other customers or third parties. Model improvements are developed using aggregated, de-identified data or data from customers who have expressly opted in.
- Subprocessors. Where we use third-party AI infrastructure providers, they are bound by contracts that prohibit them from using your data to train their models and require deletion after processing.
- Human in the loop. AI-generated content is presented as drafts for staff review; every AI draft, edit, and approval is logged.
- Controls. Programs can disable AI Features entirely or per feature, and per-child AI opt-outs are enforced platform-wide.
6. How we share information
We share personal information only as follows:
- Within your program's account: according to the roles and permissions the program configures (e.g., a family sees only its own child's information).
- Service providers (subprocessors): vendors that host, process payments, deliver email/SMS, provide AI infrastructure, or supply analytics for the Service — bound by contract to use data only to provide services to us, with confidentiality and security obligations.
- At the program's direction: e.g., exports to payroll providers, subsidy agencies, or licensing bodies that the program initiates.
- Legal reasons: when required by law, subpoena, or court order; to protect the rights, safety, or property of children, users, the public, or fx2live; or in connection with suspected fraud or abuse. Where legally permitted, we will notify the affected program before disclosing its data.
- Business transfers: in a merger, acquisition, or sale of assets, personal information may transfer subject to this policy's commitments; we will provide notice of any change in ownership or use.
- Aggregated / de-identified data: which cannot reasonably identify you or any child, for benchmarking and product improvement.
7. Security
- Encryption in transit (TLS) and at rest for all customer data;
- Role-based access controls, single sign-on options, and audit logging of record access and changes;
- Least-privilege internal access — our staff access customer data only when needed for support you request or platform integrity, and that access is logged;
- Regular third-party security testing, vulnerability management, and employee security training;
- Documented incident-response procedures. If a breach affects your data, we will notify affected programs without undue delay and in accordance with applicable law.
No system is perfectly secure; please protect your credentials and report concerns to hello@fx2live.com.
8. Data retention and deletion
- Active subscriptions: we retain data for as long as the program's subscription is active and the data is needed to provide the Service.
- After termination: programs have 60 days to export their data; we then delete or de-identify it from active systems within a commercially reasonable period, followed by scheduled purging from encrypted backups.
- Legal holds: some records (e.g., billing and tax records, or records a program must retain under childcare licensing law) may be kept longer where required, then deleted.
- Website inquiries: we keep prospect communications for up to 24 months after last contact.
9. Your privacy rights and choices
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of certain processing.
- Family and Staff Users: because your program controls its account data, please direct requests about records held in a program's account to the program; we support programs in fulfilling them. You can also update much of your own account information directly in the app.
- Website visitors and prospects: contact us at hello@fx2live.com to exercise rights over data we control. We will verify your request and respond within the time required by applicable law, and we will not discriminate against you for exercising your rights.
- Marketing opt-out: use the unsubscribe link in any marketing email or write to us.
- US state privacy laws: residents of California, Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws may have additional rights (including the right to appeal a refusal). We do not sell personal information or process it for targeted advertising, and we do not use sensitive personal information beyond providing the Service.
10. Cookies and analytics
- Essential cookies: used for sign-in, security, and session management within the Service.
- Analytics: we use privacy-respecting, first-party analytics to understand product usage. We do not use third-party advertising cookies or cross-site tracking, and the Service does not display third-party ads.
- Do Not Track / GPC: because we do not track users across third-party sites or sell data, our practices already align with these signals.
11. Where data is stored
The Service is hosted in the United States. If you access the Service from outside the US, you understand that your information will be processed in the US, where privacy laws may differ from those in your jurisdiction.
12. Changes to this policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify programs by email or in-app notice at least 30 days before the changes take effect, and update the "Last updated" date above. We will never weaken our commitments regarding children's data — no selling, no advertising use, no public model training — without obtaining fresh, explicit consent.
